Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile applications published on Google Play by Freshness Mobile Solutions ("we", "us", or "our"), a mobile app developer based in Hà Nội, Vietnam (collectively, the "Apps"), and of this website (the "Site"). By downloading, installing, or using any of our Apps or the Site, you agree to be bound by these Terms. If you do not agree, please do not use our Apps or Site.

1. Acceptance of terms

By accessing or using our Apps or Site, you confirm that you are able to form a binding contract and that you accept these Terms and our Privacy Policy, which is incorporated by reference. These Terms apply to all users of our Apps and Site.

2. License to use the Apps

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our Apps on devices you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved by us.

3. Acceptable use

You agree not to:

• Copy, modify, reverse-engineer, decompile, or create derivative works of the Apps, except where permitted by law;
• Distribute, sell, rent, sublicense, or otherwise commercially exploit the Apps;
• Use the Apps for any unlawful, harmful, or abusive purpose, or to infringe the rights of others;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Apps, our servers, or related systems;
• Remove or alter any copyright, trademark, or other proprietary notices.

4. Intellectual property

The Apps and Site, including their software, design, text, graphics, logos, and other content (excluding user content and third-party content), are owned by Freshness Mobile Solutions or its licensors and are protected by intellectual-property laws. "Freshness" and our logos are our trademarks. Wallpapers, themes, and similar content are provided for personal use only and may be subject to their respective owners' rights.

5. Third-party services & advertising

Our free Apps are supported by advertising served through Google AdMob and may use services such as Google Play services and Google Analytics for Firebase. These third parties operate under their own terms and privacy policies. We run Google Ads campaigns to promote our own Apps. Your use of third-party services is at your own risk and subject to those parties' terms; we are not responsible for third-party content or practices.

6. Disclaimers

The Apps and Site are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Apps will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate or reliable.

7. Limitation of liability

To the maximum extent permitted by law, Freshness Mobile Solutions and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Apps or Site, even if advised of the possibility of such damages.

8. Termination

You may stop using the Apps at any time by uninstalling them. We may suspend or terminate your access to the Apps or Site at any time, with or without notice, if you violate these Terms or if we discontinue an App. Provisions that by their nature should survive termination will remain in effect.

9. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Apps, business, or legal requirements. When we do, we will revise the "Last updated" date above and post the new version on this page. Your continued use of the Apps or Site after changes take effect constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws principles. Any disputes shall be subject to the competent courts located in Hà Nội, Vietnam.
